Splits and Caps Daily: Action for Agents

October 7, 2024

📈 Market Move:

“Competition Killer”

Alright, buckle up. The National Association of Realtors (NAR) is back in court, this time facing off solo against Top Agent Network (TAN). Here’s the deal: TAN’s been gunning for NAR since 2020, claiming their "Clear Cooperation Policy" kills competition and limits consumer choice. This policy requires agents to list homes on the MLS, and TAN says that’s not cool for sellers who want privacy or just want to test the market before going public.

TAN argues that NAR, through its MLS dominance, is playing dirty—stifling competition from private networks like TAN (which only lets in the top 10% of agents). The latest twist? TAN has dropped the San Francisco Association of Realtors from the lawsuit, leaving NAR to fend for itself. They’ve got 30 days to clap back.

Stay tuned.
